This Privacy Agreement (hereinafter referred to as the “Agreement”) is designed to clarify the relevant rules for Crankup Software (hereinafter referred to as the “Software”) in collecting, using, storing, protecting, and disclosing user information, in accordance with international general privacy protection guidelines (including, but not limited to, the European Union‘s General Data Protection Regulation (GDPR), the U.S. California Consumer Privacy Act (CCPA), and others), to protect the security of user personal information and their legitimate interests. By using this Software, users are deemed to have read, understood, and agreed to all terms of this Agreement. If users do not agree to this Agreement, they should immediately stop using this Software.
1. Definition and Scope
1.1 Definition
1.1.1 Users: Means natural persons, corporations, or other organizations who download, install, or use this Software.
1.1.2 Personal Information: Means various types of information that can identify or be associated with a specific user, including but not limited to device information, file information, etc.
1.1.3 Non-Personal Information: Means anonymized, de-identified information that cannot be identified or associated with a specific user, including but not limited to software usage statistics, general device parameters, etc.
1.2 Applicability Scope
1.2.1 This Agreement applies to the entire process of users using all features and services of this Software, including but not limited to core functions such as local video import, playback, and management.
1.2.2 This Agreement does not apply to third-party software or services. If users switch to a third-party platform through this software, its privacy protection rules are set forth separately by the third party, and this software assumes no responsibility in the matter.
2. Information Collection and Use
2.1 Collection Scope
2.1.1 Information Related to Device Permissions: To achieve local video import and playback functionality, this Software will request file storage permissions on the user‘s device, used only to access local video files on the user‘s device, and does not collect other device information.
2.1.2 Video Related Information: User-imported local video files (including filename, format, size, and other property information) are used only for display, playback, and management within this Software, and do not collect the video content itself.
2.1.3 Non-Personal Information: This Software may collect statistics on Software usage (such as playback counts, feature usage frequency), general device parameters (such as operating system version), for optimization of Software performance, troubleshooting, and other purposes. This information is not associated with any personal identity.
2.2 Usage Rules
2.2.1 The information collected is used only to implement the core functionality of this Software (video import, playback, management) and to optimize the user experience, and is not used for any purpose that is not related to the functionality of this Software.
2.2.2 This Software will not use the information collected for any other purpose, nor will it actively disclose it to any third party without the user‘s explicit consent.
3. Information Storage
3.1 Storage Location
3.1.1 Video files and related property information imported by the user are stored only locally on the user‘s own device and are not uploaded to any server or cloud storage of this Software.
3.1.2 Non-personal information may be temporarily stored in the local cache of this Software, and the cache data may be manually cleared by the user, or automatically deleted when the Software is uninstalled.
3.2 Storage Period
3.2.1. Video and related information stored locally, for a storage period controlled by the User, can be deleted at any time by the User through this Software feature or device action.
3.2.2. The cache period for non-personal information does not exceed 90 days, expiration will be automatically cleared, and if the user actively clears the cache, the related data will be immediately deleted.
4. Information Protection
4.1 Technology Protection
4.1.1 This Software uses cryptographic techniques to protect information stored locally from unauthorized access, tampering, or disclosure.
4.1.2 This Software performs security checks and updates regularly to fix potential security vulnerabilities and ensure the safe storage of user information.
4.2 Limitation of Responsibility
4.2.1 The Software does not assume responsibility for information leakage or loss resulting from non-Software causes such as user device malfunctions, virus attacks, or third-party software intrusions.
4.2.2 Users are solely responsible for voluntarily disclosing personal information to third parties, or for information disclosure resulting from user misconduct.
5. Information Disclosure and Sharing
5.1 Disclosure Rules
5.1.1 This Software will not voluntarily disclose or share user personal information and local video related information to any third party.
5.1.2 If disclosure is required by law, regulation, judicial authority, or administrative authority, this Software will cooperate to provide relevant information within the legal scope and will endeavor to notify users in advance (except where notification is prohibited by law and regulation).
5.2 Sharing Limits
5.2.1 This Software does not share user personal information with any third party, nor does it use user information for commercial promotion, data transaction, etc. activities.
5.2.2 Non-personal information may be used for software optimization, industry statistics, etc., and will be anonymized to ensure that it cannot be linked to specific users.
6. User Rights
6.1 Access and Management Rights
6.1.1 Users can view imported videos and related information at any time through this Software, and can perform management actions such as renaming and deleting videos.
6.1.2 Users can revoke file storage permissions for this Software at any time. After revocation, this Software will no longer be able to access video files on the user‘s device, but this does not affect the video management functionality of the imported Software.
6.2 Data Deletion Rights
6.2.1 Users can use this Software feature to delete individual or all imported videos and related information. After deletion, the data will not be recoverable.
6.2.2 When users uninstall this Software, all information related to this Software stored locally on the device (including videos, caches, etc.) will be automatically deleted.
7. Protocol Updates and Notifications
7.1 Agreement Updates
7.1.1 This Software may modify this Agreement in accordance with international privacy protection regulations updates and software functionality upgrades, and the revised Agreement will be published in a prominent location within the Software.
7.1.2 The revised agreement is effective from the date of publication, and if the user continues to use the Software, it is considered to agree to the revised agreement; if the user does not agree, they should immediately stop using the Software.
7.2 Notification Methods
7.2.1 Updates to the protocol, privacy-related notifications of this Software will be notified to users through in-Software pop-ups, message push, etc.
8. Dispute Resolution and Contact Methods
8.1 Dispute Resolution
8.1.1 Any disputes arising from or related to this Agreement should first be resolved by friendly negotiation between the User and the Software operator.
8.1.2 If a negotiation fails, either party has the right to file a lawsuit in the court with jurisdiction where the agreement was signed.
